TERMS AND CONDITIONS
1. ABOUT THESE TERMS
These Terms and Conditions (“Terms”) govern your use of www.4duav.com (the “Website”) and your purchase of any product or service from 4DUAV (“4DUAV,” “we,” “us,” or “our”). By using the Website, purchasing a product, booking a service or submitting a form, you agree to these Terms. If you do not agree, please do not use the Website or purchase from us.
4DUAV is a Canadian-based professional drone training school that provides Remotely Piloted Aircraft Systems (“RPAS”) training, flight review, consulting and operational services. Our products and services include training, flight reviews, consultations, consulting and documentation support, downloadable digital training products and physical products.
You must be legally capable of entering a binding agreement to purchase from us, and if you purchase on behalf of an organization you confirm you have authority to do so. Transport Canada sets its own eligibility, knowledge, experience and certification requirements, and purchasing or completing training with us does not override them.
2. WEBSITE AND INTELLECTUAL PROPERTY
We grant you a limited, personal, non-exclusive and revocable right to access the Website for lawful purposes. You may not copy, scrape, republish, redistribute, sell or sub-licence our content, interfere with the Website’s security or systems, or use our content unlawfully, commercially, or to provide competing training without our written authorization.
The Website does not use cookies for analytics, advertising or tracking. A video on our Resources page is embedded from YouTube in privacy-enhanced mode, and YouTube may set cookies on your device if you choose to play it, under its own policies.
All materials and content supplied by 4DUAV are owned by or licensed to us and protected by applicable intellectual-property laws. Purchasing a product does not transfer ownership. Your purchase gives you a personal, non-exclusive, non-transferable licence to use the materials for your own education and professional reference. Without our written permission you may not resell, share, redistribute, publish or reproduce substantial portions of them, use them to create competing training or to provide paid instruction, or remove any proprietary notice. Each person requiring training must obtain their own authorized copy unless a corporate or group licence provides otherwise.
You may link to the Website provided the link is not deceptive and does not imply our endorsement. Use of the 4DUAV name, logo or artwork requires our prior written agreement.
3. PURCHASES AND DIGITAL COURSES
Prices are shown in Canadian dollars unless stated otherwise, with applicable taxes and any shipping shown at checkout. Payment is processed through third-party providers operating under their own terms. We may refuse or cancel a transaction before delivery where we reasonably believe payment is fraudulent, a pricing or technical error has occurred, a stated prerequisite is not satisfied, or completing it would be unlawful; where an order is cancelled after payment, payment is refunded in full.
Where a bundle or promotion is advertised, the contents and price displayed at the time of purchase govern that transaction. Bundle benefits and promotional prices are not applied retrospectively, and a later price reduction does not entitle an earlier purchaser to a refund or credit.
Unless stated otherwise on the product page, our courses are supplied as downloadable digital products rather than subscriptions, and are considered delivered once the files have been made available for download. Customers are responsible for keeping their own secure copy.
All sales of downloadable courses and digital training materials are final and non-refundable once the product has been made available for download, except where a refund is required by applicable law. Please review the course description, level, prerequisites and requirements before purchasing; changing your mind afterwards does not create an entitlement to a refund. Faulty or inaccessible products are dealt with in our Returns and Refunds Policy, and nothing here limits consumer rights that cannot lawfully be excluded.
4. PHYSICAL PRODUCTS
Physical products are produced on demand by a third-party fulfilment partner after an order is placed and are not held in stock. Production time is separate from shipping time, and any times shown are estimates. Product images are representative, and minor variation in colour, print placement and sizing is inherent to print-on-demand manufacturing rather than a defect.
Delivery is made to the address you supply, and you are responsible for its accuracy. Title and risk pass to you on delivery. Customers outside Canada are responsible for any customs duties, import taxes and handling fees.
Physical products are general merchandise. They are not safety equipment, are not aviation-certified, and nothing printed on a product constitutes operational guidance or evidences any certification or authorization. Returns, replacements and refunds are governed by our Returns and Refunds Policy.
5. TRAINING, FLIGHT REVIEWS AND SERVICES
Flight reviews are in-person practical assessments. Payment covers the assessment and does not guarantee a successful result, an unsuccessful review does not create an entitlement to a refund, and additional fees may apply where further training or another review is required. Students are responsible for arriving on time, properly prepared, and with any required identification, documentation, prerequisite certification and suitable equipment.
Where a student provides their own aircraft, the student remains responsible for its registration, airworthiness, condition, documentation, insurance and safe operation. Where we provide an aircraft, additional fees and conditions may apply and our directions concerning the equipment must be followed. We may refuse, postpone or discontinue any practical session where weather, airspace, aircraft, site conditions, preparedness or any other circumstance creates an unacceptable safety or regulatory concern.
Corporate, government, group and specialized training may be governed by a separate quotation or agreement and may carry additional requirements and fees. Our consulting and documentation work depends partly on information supplied by the client, who remains responsible for its accuracy and for implementing and maintaining their own procedures, documentation and compliance. Consultations provide professional guidance; they are not legal advice and do not guarantee a regulatory outcome. Where a separately negotiated agreement conflicts with these Terms, that agreement governs the service it covers.
6. CANCELLATIONS AND RESCHEDULING
Flight reviews, practical training and other scheduled in-person training require at least 72 hours’ notice to cancel or reschedule. Consultations and coaching appointments require at least 24 hours’ notice.
Where the required notice is given, the session may be rescheduled without charge, subject to availability. Where less notice is given, or where you do not attend, the session fee may be forfeited and a new booking and payment may be required.
These requirements do not apply where we cancel or postpone, or where we or the responsible instructor or flight reviewer determine that a session cannot safely or lawfully proceed. In those cases the session is rescheduled without charge, or a full refund is offered for a paid consultation.
7. REGULATORY RESPONSIBILITY AND NO GUARANTEES
4DUAV is an independent training and professional services provider. We are not Transport Canada, do not act on its behalf, and cannot issue, guarantee or expedite any certificate, result, authorization, exemption or approval. Appearing on a Transport Canada list or directory does not mean Transport Canada endorses our statements, courses or products.
Canadian aviation regulations and guidance change. Our materials reflect the information available when they were prepared, and because downloaded products remain in your possession we cannot guarantee a previously downloaded version remains current. Before conducting an operation you must verify current requirements against applicable legislation and authoritative regulatory sources.
The pilot in command and the operator remain responsible for the safe and lawful conduct of every RPAS operation, including certification, registration, airworthiness, airspace assessment, authorizations, risk management, insurance and compliance with applicable law. Training does not transfer these responsibilities to 4DUAV.
Purchasing, reading or completing our training does not guarantee that you will pass any examination or flight review, obtain any certificate, authorization or approval, or achieve any employment, contract, revenue or procurement outcome. Outcomes depend on your own knowledge, preparation, performance, equipment and circumstances. Testimonials and case studies describe individual experiences and do not guarantee the same outcome for anyone else.
8. INFORMATION, THIRD PARTIES AND LINKS
Our information and training is provided for educational and general informational purposes unless we have expressly entered a separate professional consulting engagement, and cannot account for every aircraft, site, airspace environment or operation. Nothing on the Website or in our general materials is legal advice. We make reasonable efforts to be accurate but do not warrant that all information is error-free, complete or current, or that the Website will remain available.
The Website interacts with third-party providers, including payment processors, our fulfilment partner, carriers and technology providers, each operating under their own terms and privacy policies. Where we discuss or recommend equipment, software or services, you remain responsible for determining whether it is suitable and lawful for your intended operation.
Some links are affiliate links, and we may receive compensation if you purchase through one, at no additional cost to you. Material affiliate relationships are disclosed on the pages where those links appear. A purchase made on a third-party retailer’s website is a contract between you and that retailer. We do not control third-party websites and are not responsible for their availability, accuracy, security or privacy practices.
9. WARRANTIES AND LIABILITY
To the maximum extent permitted by applicable law, the Website and our general educational materials are provided on an “as is” and “as available” basis, and we exclude all representations, warranties and conditions relating to the Website and its use.
To the fullest extent permitted by applicable law, 4DUAV will not be liable for indirect, incidental, special or consequential loss arising from use of the Website, our courses, materials, products or services, or from reliance on general Website or training information, including lost profit, revenue, business or opportunity, business interruption, regulatory penalties, enforcement action and aircraft damage.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or limits any liability in a way not permitted under applicable law, or removes rights or warranties that cannot lawfully be excluded.
10. GENERAL
We may terminate permission to use our materials where we reasonably determine that a purchaser has unlawfully shared or redistributed them, used them commercially without authorization, committed fraud or materially breached these Terms. Termination does not transfer ownership of our intellectual property.
These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, and nothing in them removes consumer rights that cannot legally be waived.
These Terms should be read together with our Privacy Policy and our Returns and Refunds Policy, each of which forms part of these Terms and is incorporated by reference. Where a separate written proposal, quotation or service agreement applies, that document governs to the extent of any inconsistency. Together these constitute the entire agreement between you and 4DUAV.
We may update these Terms as our business, products, services or legal obligations change. The current version is published on www.4duav.com with its effective or revision date.
