Terms of Use
These Terms of Use (“Terms”) govern your access to and use of www.4duav.com (the “Website”) and your purchase and use of courses, downloadable training materials, flight reviews, practical training, consulting and other services provided by 4DUAV Solutions Inc. (“4DUAV Solutions Inc.,” “we,” “us,” or “our”).
Please read these Terms carefully before using the Website or purchasing a product or service.
By accessing the Website, purchasing or downloading a course, booking a service, submitting a form or otherwise engaging 4DUAV Solutions Inc., you agree to these Terms.
Our Privacy Policy and Disclaimer should be read together with these Terms.
1. ABOUT 4DUAV SOLUTIONS INC.
4DUAV Solutions Inc. is a British Columbia-based professional Remotely Piloted Aircraft Systems (“RPAS”) training, flight review, consulting and operational services company.
We provide services that may include:
- Basic RPAS ground-school training;
- Advanced RPAS ground-school training;
- Level 1 Complex (“L1C”) training;
- flight reviews;
- practical flight training;
- specialized RPAS training;
- corporate and government training;
- operational consulting;
- RPAS program development;
- Flight Operations Manuals;
- Standard Operating Procedures;
- Safety Management System documentation;
- RPOC readiness support;
- SFOC support; and
- other professional RPAS services.
2. ELIGIBILITY
You must be legally capable of entering into a binding agreement to purchase our products or services.
Transport Canada establishes its own age, eligibility, knowledge, experience, examination and certification requirements for RPAS pilot certificates and operations.
Purchasing or completing training through 4DUAV Solutions Inc. does not override those requirements.
If you purchase training or services on behalf of a company, government agency or other organization, you represent that you have authority to enter into these Terms on its behalf.
PART I — WEBSITE USE
3. PERMITTED USE
4DUAV Solutions Inc. grants you a limited, personal, non-exclusive and revocable right to access the Website for lawful purposes.
You may not:
- copy or systematically scrape Website content;
- attempt unauthorized access to the Website or its systems;
- introduce malware or harmful code;
- interfere with Website security;
- impersonate another person or organization;
- use Website content for unlawful purposes;
- reproduce our training materials for commercial purposes;
- resell our intellectual property; or
- use our materials to provide competing training without written authorization.
PART II — COURSE PURCHASES AND DOWNLOADABLE TRAINING
4. DIGITAL COURSE FORMAT
Unless expressly stated otherwise on the applicable product page, 4DUAV Solutions Inc. courses sold through the Website are supplied as downloadable digital training products.
They are not subscription products and do not require continuing login access to an online learning-management system unless specifically stated otherwise for a particular product.
Once the purchased course files or digital materials have been made available to the purchaser for download, the digital product is considered delivered.
Customers are responsible for maintaining their own secure copy of downloaded course materials.
5. COURSE PURCHASES
Prices are displayed in Canadian dollars unless otherwise stated.
Applicable taxes may be added at checkout.
Payment may be processed through third-party payment providers, including Stripe and PayPal.
A purchase is completed when:
- payment has been successfully processed; and
- the purchased digital product has been made available for delivery or download.
4DUAV Solutions Inc. may refuse or cancel a transaction before delivery where we reasonably believe:
- payment is fraudulent;
- a pricing or technical error has occurred;
- the purchaser does not satisfy a clearly stated prerequisite; or
- completing the transaction would violate applicable law.
6. ALL DOWNLOADABLE COURSE SALES ARE FINAL
Because our digital courses and training materials are downloadable and cannot practically be returned after delivery:
ALL SALES OF DOWNLOADABLE COURSES AND DIGITAL TRAINING MATERIALS ARE FINAL AND NON-REFUNDABLE ONCE THE DIGITAL PRODUCT HAS BEEN MADE AVAILABLE FOR DOWNLOAD, EXCEPT WHERE A REFUND IS REQUIRED BY APPLICABLE LAW.
Customers should carefully review:
- the course description;
- course level;
- prerequisites;
- included materials;
- technical requirements;
- bundle contents; and
- applicable Transport Canada requirements
before purchasing.
Changing your mind after purchasing or deciding that you no longer require the course does not create an entitlement to a refund.
Nothing in this section limits consumer rights that cannot lawfully be excluded.
PART III — COURSE BUNDLES
7. BASIC, ADVANCED AND L1C BUNDLES
4DUAV Solutions Inc. may offer bundled course packages.
Where advertised:
Advanced Bundle
An Advanced course purchase may include the Basic course when both are expressly offered together as part of the Advanced package at the time of purchase.
Level 1 Complex Bundle
An L1C purchase may include Basic and Advanced courses when all three are expressly offered together as part of the L1C package at the time of purchase.
Bundle benefits apply only at the time of the qualifying purchase.
A customer who previously purchased Basic and later purchases Advanced is not automatically entitled to receive a retrospective bundle discount, refund or credit unless 4DUAV Solutions Inc. expressly offers one.
Similarly, a customer who previously purchased Basic or Advanced and later purchases L1C is not automatically entitled to a refund, credit or retroactive bundle price.
The contents and price of the bundle displayed when the bundle is purchased govern that transaction.
8. PROMOTIONS AND PRICE CHANGES
4DUAV Solutions Inc. may offer promotions, discount codes, bundled pricing or limited-time offers.
Unless a promotion expressly states otherwise:
- promotional prices apply only during the stated promotion;
- promotions cannot be applied retrospectively;
- discounts cannot be exchanged for cash;
- discounts may not be combined; and
- a later reduction in price does not entitle an earlier purchaser to a refund or credit for the difference.
PART IV — COURSE CONTENT AND REGULATORY CHANGES
9. COURSE INFORMATION
RPAS regulations, standards, guidance and operational requirements can change.
4DUAV Solutions Inc. makes reasonable efforts to prepare training materials using information considered current when the materials are produced or revised.
However, downloaded materials represent the information available at the time of publication or revision.
Students remain responsible for confirming current regulatory requirements before conducting RPAS operations.
10. TRANSPORT CANADA REQUIREMENTS
4DUAV Solutions Inc. is an independent training provider.
We are not Transport Canada and cannot issue, guarantee or expedite a Transport Canada pilot certificate, examination result, flight-review result, authorization, exemption or approval.
Students remain responsible for satisfying all applicable Transport Canada requirements.
PART V — INTELLECTUAL PROPERTY AND COURSE LICENCE
11. OWNERSHIP
All course materials and other content supplied by 4DUAV Solutions Inc., including:
- manuals;
- course documents;
- videos;
- presentations;
- illustrations;
- diagrams;
- test-preparation materials;
- question banks;
- checklists;
- templates;
- instructor materials;
- flight-review preparation materials;
- graphics; and
- downloadable resources
are owned by or licensed to 4DUAV Solutions Inc. and are protected by applicable intellectual-property laws.
Purchasing a course does not transfer ownership of the intellectual property.
12. PERSONAL USE LICENCE
Your purchase gives you a personal, non-exclusive, non-transferable licence to use the purchased materials for your own education and professional reference.
Unless we provide written permission, you may not:
- resell the course;
- redistribute course files;
- upload them to file-sharing websites;
- share purchased files with other students;
- reproduce substantial portions;
- publish the materials online;
- use them to create competing training;
- provide paid instruction using our materials; or
- remove copyright or proprietary notices.
Each person requiring training must obtain their own authorized copy unless a corporate or group licence provides otherwise.
PART VI — FLIGHT REVIEWS AND PRACTICAL TRAINING
13. FLIGHT REVIEWS
Flight reviews are in-person practical assessments.
Completing a 4DUAV Solutions Inc. ground-school course does not guarantee that you will successfully complete a flight review.
Students are responsible for arriving:
- at the scheduled time;
- properly prepared;
- with required identification;
- with required Transport Canada documentation;
- with any prerequisite certification; and
- with suitable equipment where they are providing their own aircraft.
14. STUDENT AIRCRAFT
Where a student uses their own aircraft, the student is responsible for its:
- registration;
- airworthiness;
- configuration;
- firmware/software condition;
- batteries;
- required documentation;
- safe operation; and
- appropriate insurance.
4DUAV Solutions Inc. may refuse to conduct or continue a practical session if an aircraft, operating site, weather condition or other circumstance creates an unacceptable safety or regulatory concern.
15. 4DUAV SOLUTIONS INC. AIRCRAFT
Where 4DUAV Solutions Inc. provides an aircraft for training or a flight review, additional fees, requirements and conditions may apply.
The student must follow all instructor or flight-reviewer directions concerning the equipment.
PART VII — CANCELLATIONS AND RESCHEDULING
16. CANCELLATION BY 4DUAV SOLUTIONS INC.
If 4DUAV Solutions Inc. must cancel a scheduled flight review, practical training session or other scheduled training service:
the customer will receive free rescheduling.
The replacement session will be arranged for a mutually available date and time.
17. WEATHER AND SAFETY
Aviation training is dependent on suitable:
- weather;
- visibility;
- airspace;
- aircraft;
- site conditions; and
- other safety factors.
4DUAV Solutions Inc. or the responsible instructor/flight reviewer may postpone or terminate a practical session where conditions are unsuitable.
Where 4DUAV Solutions Inc. cancels or postpones the session for weather or safety reasons, the session will be rescheduled without a rescheduling fee.
18. STUDENT CANCELLATIONS AND NO-SHOWS
Students who need to cancel or reschedule a scheduled flight review, practical training session or other scheduled in-person training service must provide at least 72 hours' notice before the scheduled start time.
Cancellations or Rescheduling With 72 Hours' Notice
Where at least 72 hours' notice is provided, the student may reschedule the session without a rescheduling fee.
The replacement session will be arranged based on instructor or flight-reviewer availability.
Cancellations With Less Than 72 Hours' Notice
Where less than 72 hours' notice is provided, the session fee may be forfeited and a new booking and payment may be required.
No-Shows
A student who does not attend a scheduled session and has not provided the required 72 hours' notice will be considered a no-show.
The session fee will be forfeited and a new booking and payment will be required to schedule another session.
Exceptions for 4DUAV Solutions Inc. Cancellations, Weather and Safety
The 72-hour requirement does not apply where 4DUAV Solutions Inc. cancels or postpones the session.
Where 4DUAV Solutions Inc. cancels, the student will receive free rescheduling.
The requirement also does not apply where 4DUAV Solutions Inc. or the responsible instructor or flight reviewer determines that the session cannot safely or lawfully proceed because of weather, airspace restrictions, aircraft availability, site conditions or another operational or safety concern.
In those circumstances, the session will be rescheduled without a rescheduling fee.
19. UNSUCCESSFUL FLIGHT REVIEWS
Payment for a flight review covers the assessment service and does not guarantee a successful result.
An unsuccessful flight review does not create an entitlement to a refund.
Where additional training or another flight review is required, additional fees may apply.
PART VIII — CORPORATE AND SPECIALIZED TRAINING
20. CORPORATE TRAINING
Corporate, government, emergency-services and group training may be governed by a separate quotation, statement of work, contract or training agreement.
Where such an agreement conflicts with these Terms, the specifically negotiated agreement will govern the applicable service.
21. SPECIALIZED TRAINING
Specialized training may have additional:
- prerequisites;
- safety requirements;
- aircraft requirements;
- operational limitations;
- insurance requirements;
- location requirements; and
- fees.
These will be communicated where applicable.
PART IX — CONSULTING
22. CONSULTING AND DOCUMENTATION
4DUAV Solutions Inc. may provide consulting and documentation services, including RPOC readiness, SFOC support, FOMs, SOPs, SMS documentation and operational risk-management support.
Deliverables depend partly upon information supplied by the client.
Clients remain responsible for:
- providing accurate information;
- implementing procedures;
- maintaining current documentation; and
- ongoing regulatory compliance.
Transport Canada retains authority over regulatory approvals.
4DUAV Solutions Inc. does not guarantee approval or a particular regulatory timeline.
PART X — DISCLAIMERS AND LIABILITY
23. NO GUARANTEE OF CERTIFICATION
Purchasing, downloading or completing a 4DUAV Solutions Inc. course does not guarantee:
- passing a Transport Canada examination;
- passing a flight review;
- receiving a pilot certificate;
- obtaining an SFOC or RPOC;
- obtaining employment;
- obtaining a commercial contract; or
- receiving any particular regulatory authorization.

24. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, 4DUAV Solutions Inc. will not be liable for indirect, incidental, special or consequential loss arising from use of the Website, courses, downloadable materials or services.
This may include lost profits, lost business, lost opportunity, aircraft damage, regulatory penalties or business interruption.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
PART XI — GENERAL
25. THIRD-PARTY SERVICES
Our Website may interact with third-party providers including payment processors, video services and other technology providers.
Those organizations operate under their own terms and privacy policies.
26. SUSPENSION AND TERMINATION
4DUAV Solutions Inc. may terminate permission to use our materials where we reasonably determine that a purchaser has:
- illegally redistributed course materials;
- shared copyrighted course files;
- used our materials commercially without authorization;
- committed fraud; or
- materially breached these Terms.
Termination does not transfer ownership of our intellectual property to the purchaser.
27. GOVERNING LAW
These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada.
Nothing in these Terms removes consumer rights that cannot legally be waived.
28. CHANGES
We may update these Terms when our business, services or applicable law changes.
The current version will be published on www.4duav.com with its effective or revision date.
